Na venčanje bez mladoženje

Pri sklapanju braka u Republici Srpskoj jedan od bračnih supružnika, bilo mlada ili mladoženja, ukoliko imaju određene razloge, ne moraju biti prisutni na svom venčanju

BANJALUKA - Porodičnim zakonom RS regulisano je, naime, da nadležni opštinski organ može dozvoliti da se brak zaključi u prisustvu samo jednog od bračnih supružnika. Za supružnika koji nije prisutan morala je biti izvađena punomoć overena u sudu. Međutim, ova neobična varijanta sklapanja braka uskoro će biti još jednostavnija, istraživanjem saznaju Nezavisne novine.

Prema rečima Nikole Kovačevića, pomoćnika ministra pravde RS, Nacrtom zakona o izmenama i dopunama Porodičnog zakona RS koji je nedavno usvojen u Narodnoj skupštini regulisano je da će se punomoć za onog bračnog supružnika koji ne prisustvuje zaključenju braka moći overiti i kod notara.
- Notari su nova institucija koja je uvedena u naš sistem i ono što je sada menjano u važećem zakonu odnosi se samo na usaglašavanje postojećeg porodičnog zakona s odredbama Zakona o notarima. Znači, ono što su do sada radili sudovi i drugi organi dato je na ovlašćenje i notarima - objašnjava Kovačević.

Prema važećem zakonu, da bi neko zaključio brak, potrebno je da budu ispunjeni sledeći uslovi: da su dva lica različitih polova i da imaju saglasnu izjavu volja koju će dati pred nadležnim organom. Znači, osnovno je pravilo da prilikom zaključenja braka budu prisutna oba buduća supružnika.

Međutim, Kovačević navodi da je napravljen jedan izuzetak u članu 23 važećeg Porodičnog zakona koji kaže da organ uprave može u određenim slučajevima dozvoliti da se brak zaključi u odsustvu jednog od bračnih drugova.

- Znači, ako postoji određeni razlog, a treba brak zaključiti, nadležni upravni organ će to razmotriti i doneti rešenje da se dozvoli zaključenje braka uz prisustvo jednog bračnog druga, pod uslovom da u ime drugog budućeg bračnog druga koji je odsutan ima overenu punomoć. Ranije je ta punomoć morala biti overena u sudu, a sada je dozvoljeno da ona može biti overena i od strane notara - kaže Kovačević.

Prema rečima Rajke Knežević, matičara iz Prijedora, u ovoj opštini je bilo slučajeva venčanja putem punomoći.
- Iako ne baš često, proteklih godina se dešavalo da jedan od bračnih drugova bude prisutan na venčanju, a drugi ne. Znači, to je venčanje po punomoći, odnosno preko opunomoćenika - kaže Kneževićeva.

Uglavnom su to, kako navodi, slučajevi kada jedan od budućih bračnih drugova živi u inostranstvu, a iz određenih razloga ne može doći na venčanje, a trebaju se hitno venčati. Međutim, Duško Pavlović, matičar iz Doboja, tvrdi kako za njegovih 15 godina rada u matičnoj službi nije imao nijedan slučaj takvog venčanja.
- Iako venčanje putem punomoći, odnosno uz prisustvo samo jednog bračnog druga, u određenim slučajevima ima pravne osnove, mislim da se zbog duge procedure mali broj ljudi odlučuje na takvo sklapanje braka. I kada se odluče na tako nešto, onda su to uglavnom slučajevi kada je jedan od budućih supružnika iz inostranstva - smatra Pavlović.
